Artistically.in acts as an intermediary and is not responsible for the accuracy, quality, or legality of Third-Party Content.

 

6. Artistically.in Originals

The Platform also offers content commissioned or procured by Artistically.in under licenses or copyright agreements ("Artistically.in Originals"). The availability and quality of the Content or Services may vary based on various factors such as geographical location, internet connectivity, and device compatibility.

 

7. Intellectual Property

All materials on the Platform, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Users are granted rights for personal, non-commercial use only. Any commercial use is prohibited unless expressly authorized by the respective rights holder.

 

8. Commission-Based Selling

The Platform operates on a commission-based model, allowing artists to showcase and sell their artworks. Upon a successful sale, Artistically.in will facilitate the transaction and deduct the agreed-upon commission before disbursing the remaining amount to the artist.

 

9. Limitation of Liability

IN NO EVENT SHALL ARTISTICALLY.IN BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF USE, EVEN IF USERS HAVE BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.

 

10. Applicable Law and Jurisdiction

These Terms of Use shall be governed by and interpreted in accordance with the laws of India. The place of jurisdiction shall be exclusively in Bangalore.

Profanity Policy

Artistically.in prohibits the use of language that is racist, hateful, sexual, or obscene in nature in any public area.

Replacement Guarantee

Buyers who have been defrauded by qualified sellers can ask for a replacement if any defect is found in the artwork within the specified days from the date of delivery.

Returns Policy

Buyers can return artworks under specific conditions such as defects, damage during shipping, missing products, or incorrect items sent by the artist.

Disputes (Resolutions) Policy

Disputes between buyers and sellers are resolved through our Dispute Resolution process. Buyers and sellers are encouraged to attempt to resolve issues before raising a dispute.

Buyer Protection Program

Our Buyer Protection Program covers buyers who are unable to resolve their disputes with sellers. Buyers can file a dispute within a specified period from the date of delivery.

Email Abuse & Threat Policy

Artistically.in investigates and takes action on certain types of unwanted emails that violate our policies, including threats, system misuse, spoof emails, spam, and offers to buy or sell outside of the platform.

Artistically.in does not take responsibility or liability for the actions, products, content, and services on third-party platforms linked to our Platform.

Infringement Verification

Artistically.in has a process for reporting listings that infringe on intellectual property rights. Verified Rights Owners can report potentially infringing products or listings through our Infringement Verification process.
